OLMCA/Microsoft Surface Laptop Lease Agreement

This document sets out the leasing agreement for the management and maintenance of a Microsoft Surface Laptop, including all ancillary items such as hard case, Type Cover, stylus, charger, and soft carry case. This supersedes all agreements prior to May 2023.

Preamble

Learning in today’s world for participation in tomorrow’s society offers several challenges, one being the provision of laptop devices for students within the classroom environment. Our Lady of Mercy College (the College) believes that all students should develop the essential technology skills to access a range of information sources to enhance their learning.

By providing a laptop to each student, the College ensures that the learning environment is equitable. In addition, the College provides access to current software and technical support.

This agreement sets out the conditions and understandings for both parents and the College to ensure students can productively use and access technology whilst onsite.

Agreement

As parent(s)/guardian(s) of the student named below, I/we agree to ensure that my child treats the equipment in a safe manner and always ensures the security of the laptop.

  1. I/We acknowledge that an extended 3-year warranty is provided for the Surface Laptop only, covering any hardware malfunction. If there is the need for warranty service, the College requires that the Surface Laptop be presented to the IT Help Desk to access such warranty.
  2. I/We acknowledge that warranty is provided for accidental damage only – loss due to fire/theft is not covered. This warranty cover pertains to the Surface Laptop only and does not include any accessories such as Type Cover, stylus, charger, and case. The first two accidental damage claims will require the payment of a $150.00 excess fee. The third and subsequent accidental damage claims will require the payment of a $750.00 excess fee. All malicious damage automatically attracts a $750.00 excess fee regardless of warranty status.
  3. The College strongly advises parent/guardians to include their Surface Laptop and accessories on their personal effects or home & contents insurance to cover against loss from fire/theft. If there is a loss due to fire/theft, the College requires this is reported through the IT Help Desk, with a Theft/Fire Loss Incident Notification Form to be completed. Any in-house fire/theft claims are accepted at the discretion of the College. These will attract a pro-rata fee based upon the amount of IT Levy paid for the device. If a theft occurs, their parent(s)/guardian(s) are required to lodge a ‘theft’ report with the local police or online at: https://www.police.wa.gov.au/Police-Direct/Report-Stolen-or-Damaged-Property and notify the College of the incident report number on the Theft/Fire Loss Incident Notification Form.
  4. The College requires that each student takes individual responsibility for recharging the Surface laptop’s battery, ensuring it is fully powered for each school day.
  5. If a student completes Year 12 at the College, they obtain full ownership of the Surface Laptop and all ancillary items (Type Cover, stylus, charger and cases). Should a student leave the College at any time prior to Year 12 completion, the Surface Laptop and all its ancillary items remain the property of the College.
  6. There are two compulsory recalls of Surface Laptops. Each returned device is examined for damage or missing accessories. Such damage or missing accessories may attract charge(s) to a total maximum of $150.00. The first recall is for all Year 10 students at the commencement of the year, whereby new Surface laptops will be issued to all Year 10 students, upon parents signing the relevant agreement. The second recall is for all Year 12 students at the end of the year. The College will restore the device to a base Windows installation and return it to the student.
  7. Should a device not be returned to the College when requested at any time via written or verbal notice, the College reserves the right to remotely wipe the device of its digital contents. Furthermore, the balance of the device’s lease will still require payment. In some circumstances the College has the right to charge the full price of the device.

I/We have read and agreed to the above terms and conditions relating to the use of a Microsoft Surface Laptop device provided by Our Lady of Mercy College.
